Terms & Conditions

1. Eligibility

You must be at least the minimum age required in your country to use the App and to consent to the processing of your data. If you are under 18, you may use the App only with verifiable consent from a parent or legal guardian. By using the App you confirm you meet these requirements.

2. Beta Software

Runiverse is currently in Open Beta. This means:

• The App may contain bugs, errors, incomplete features, and instability.
• Features, mechanics, points, rankings, territory, and data may change, reset, or be removed at any time without notice.
• We provide the App on an "as is" and "as available" basis with no guarantee of uptime, accuracy, or data persistence.

3. Your Account

• You are responsible for the accuracy of your registration information.
• You are responsible for keeping your password, Google Sign-In, OTPs, and account secure.
• You must not share your account or let others use it.
• Notify us immediately of any unauthorised use.
• We may suspend or terminate accounts that violate these Terms.

4. Licence to Use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms. We retain all rights not expressly granted.

5. Acceptable Use

You agree not to:

• Falsify, spoof, simulate, or manipulate GPS location or activity data (including mock-location apps, teleporting, or any tool that fakes movement).
• Use bots, scripts, automation, or any method to gain unfair advantage in territory capture, leaderboards, points, or rankings.
• Reverse-engineer, decompile, scrape, or attempt to extract source code or data except as permitted by law.
• Interfere with, overload, or attack the App's infrastructure or security (including the authentication or Territory Engine systems).
• Use the App for any unlawful purpose or in violation of any third party's rights.
• Upload or share content that is illegal, harmful, harassing, defamatory, infringing, or obscene.
• Trespass or break any law while recording activities.

We use anti-cheat measures (including teleport rejection and route validation). We may void activities, remove territory or points, and suspend or ban accounts we reasonably believe are cheating or violating these Terms.

6. Physical Activity - Health & Safety Disclaimer

Running, walking, and jogging carry inherent risks. By using the App you acknowledge and agree that:

• You participate in all physical activity voluntarily and at your own risk.
• You should consult a doctor before starting any exercise program, especially if you have a medical condition.
• The App is not a medical device and does not provide medical, health, or fitness advice. Stats such as calories, pace, and elevation are estimates and may be inaccurate.
• You are solely responsible for your safety, surroundings, traffic, terrain, weather, and chosen routes. Stay aware of your environment and obey all laws.
• We are not liable for any injury, accident, health issue, property loss, or death arising from your use of the App or your physical activity.

7. Gamification, Territory, and Virtual Items

• Points (the UNI System), tiers, rankings, seasonal progress, streaks, and claimed territory are virtual game elements with no monetary or real-world value.
• They are not property, currency, or transferable assets and cannot be redeemed for cash.
• "Claiming territory" is an in-game mechanic only and grants no real-world rights over any physical land or location.
• We may adjust, reset, recalculate, or remove any virtual elements at any time, including for balance, anti-cheat, or seasonal reasons.

8. User Content & Shared Images

• You retain ownership of content you create.
• By posting or sharing content through the App, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it as needed to operate and promote the App.
• Activity-summary images generated by the App are yours to share; you are responsible for what you choose to make public.
• You are responsible for ensuring your content does not infringe others' rights or laws.

9. Third-Party Services

The App relies on third-party services (including Google Sign-In, map/routing providers such as Mapbox, hosting, and email/OTP delivery). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or their availability.

10. Intellectual Property

The App, including its name, logo, design, code, the Territory Engine, the UNI System, graphics, and all related materials, is owned by Runiverse Technologies and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Suspension & Termination

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your access at any time, with or without notice, if you violate these Terms, cheat, or pose a risk to the App or other users.
• On termination, your licence ends. Provisions that by their nature should survive (e.g., disclaimers, liability limits, IP) will survive.

12. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that data (including stats, location, and territory) will be accurate or preserved.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Runiverse Technologies and its affiliates, founders, officers, directors, employees, contractors, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or other intangible losses arising out of or relating to your use of, or inability to use, the App.

This limitation applies whether the claim is based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Without limiting the foregoing, we are not responsible for damages arising from AI-generated content, user-generated content, service interruptions, downtime, security incidents, unauthorized access, or loss of data.

Our total aggregate liability for all claims arising out of or relating to the App will not exceed the greater of (a) the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim, or (b) INR 100.

Some jurisdictions do not allow certain limitations or exclusions of liability. In such jurisdictions, the foregoing limitations and exclusions will apply only to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Runiverse Technologies, its founders, and team from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your content, your physical activity, or your violation of these Terms or any law or third-party right.

15. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at Gujarat, India will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction.

16. Changes to These Terms

We may update these Terms. The "Last updated" date reflects the latest version. Continued use of the App after changes means you accept the updated Terms.
